Terms and Conditions

The following terminology applies to these Terms and Conditions, Privacy Policy and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the service user.  “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company – Recovery Designed Pty Ltd  (trading under the NowWhat Brand), shareholders, staff and counsellors. “Party”, “Parties”, or “Us”, refers to both the service user and the service provider.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the service user in the most appropriate manner for the express purpose of meeting the service users’ needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of South Africa and United Kingdom.  Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

These terms and conditions outline the rules and regulations for the use of Recovery Designed Limited’s Services including the NowWhat Relapse Prevention App.

By signing our client agreement you automatically agree to these terms and conditions.

Cookies

We employ the use of cookies. By accessing www.nowwhat.net or www.relapsepreventionapp.com you agreed to the use of cookies in agreement with the Recovery Designed Limited’s Privacy Policy and the POPIA Act of 2021 in order to track traffic on the website.

Confidentiality of information.

The company is strictly governed by standards that ensure that your personal information be kept safe and secure and will not be used for third parties use.  We will request the service user to fill in a consent to release information regarding progress notes with our trained counselling team only and that with specific permission to the service users’ family or others stipulated in our Consent to release document within our Client Agreement.

NowWhat Relapse Prevention App:

There are features within the Application that require us as the company to access daily journals, emergency responses and personal information such as name, contact number and email address in order to fulfil our services to the service user.

The application

Sponsor: (Counsellor, Wise Counsel)

The Sponsor is a term given in the recovery fields as a person(s) that provide support, guidance and perspective to life situations that help you make healthier decisions that protect you from dangerous or risky situations.

By signing the client agreement form you give permission to your sponsor, counsellor or wise counsel access to the location tracking service and the daily journal entries on the NowWhat relapse prevention app. This is in line with our service to provide accountability, and daily support to combat toxic thoughts, that lead to self-destructive behaviours and decisions.  Therefore, we require permission to access your journal and location tracking which allows the sponsor, counsellor or wise counsel the tools in order to contact the service user in order to intervene and offer new perspective and challenge the thought process.

Payment Terms:

We offer our services based on an upfront payment, or a debit order for payment plans. The company is obligated to debit accounts according to the client agreement signed by the service user as well as the Debit Order form, in order to cover the expenses of the services provided. 

If at all there is issues with payment, an email is requested to be sent 5 working days prior to invoice for services in order to discuss options as to dates available for payment.  Failure to adhere to the agreed payment terms will result in services being stopped immediately and to cover any outstanding payments owed for services rendered before continuing with the service term agreed in the client agreement.

Disclaimer:

We Strongly express that we do not diagnose mental illnesses or psychiatric disorders in any way, shape or form.  We will at times refer or recommend seeking psychiatric or psychological support in conjunction to our program as we may be dealing with dual diagnosis. We strongly recommend that you should seek medical attention and registered treatment in cases of severe addiction or mental disorder. You as the service user acknowledge that we are not a registered treatment service, and therefore utilise our services for the use of the recovery management tools provided in conjunction with the contracted counsellors we outsource to provide the service only.

We as the company are exempt and  

  • limit or exclude our liability for death or personal injury;
  • limit or exclude our liability for the service user self-harming, self-destructive behaviour including suicide.
  • limit any of our liabilities in any way that is not permitted under applicable law; or
  • exclude any of our liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.  We as the company will recommend and refer accordingly if the service user or the company deem that further treatment is required.
